PODCAST, TESTIMONIAL, CASE STUDY AND SOCIAL MEDIA LICENSE AND RELEASE

Guest (as set forth below) does hereby consent to the recording, photography, unrestricted use, and distribution of reproduction(s) of the Guest's name, biography, image, likeness, voice, performance, story, photo, or other items (together, “Materials”), as part of Optimal Blue's various marketing and social media efforts (herein referred to as the "Program"). This is to confirm that the undersigned has agreed voluntarily to be interviewed or otherwise participate in the Program, a production of Optimal Blue, LLC, including its successors and assigns (“Optimal Blue”).

Guest grants Optimal Blue, for no monetary or other compensation now or at any time in the future, a non-exclusive, unrestricted, irrevocable worldwide right in perpetuity to use, edit, transcribe, reproduce, and/or distribute the Materials, in whole or in part, for any purpose whatsoever in any media, including without limitation, any and all print, electronic, or other media, including but not limited to social media outlets via any means (collectively “social media”), published under the auspices of Optimal Blue, and to license or sell these rights to others. Guest acknowledges that they have not received any compensation for participation in this Program or for their Materials and have no right to seek any compensation therefor at any time in the future.

Guest hereby releases Optimal Blue, its representatives, employees, managers, members, officers, directors, parent companies, subsidiaries, insurers, attorneys, sponsors and agents, from any and all claims and demands arising out of or in connection with any use of the Materials, including, without limitation, all claims for invasion of privacy, infringement of right of publicity, defamation and any other personal and/or property rights arising out of or in connection with, any alteration, or use of the Materials.

To the extent that Guest supplies any presentation or compiled information as part of the Program, Guest warrants that any such information or presentation is owned by and original to Guest and that publication/broadcast of such information or presentation will not infringe on the rights of others. Should Guest’s presentation/broadcast incorporate copyrighted materials of others, Guest warrants that they have obtained such permission from those parties for publication/broadcast by Optimal Blue, consistent with this release form and agrees to indemnify and hold Optimal Blue, harmless from all claims of infringement.

Guest agrees any discussions or materials will not include any competitive information and will at all times remain lawful, ethical and under fair business practices. 

Guest warrants that Guest has full power and authority to grant the license and release set forth herein and voluntarily consents to the use of the Materials as described and agrees with the provisions of this license and release form.
